A BILL FOR AN ACT CONCERNING THE INDIVIDUAL RIGHT OF SELF DEFENSE AND DEFINING THE ROLE .AND RESPONSIBILITIES OF A TRUE VICTIM IN AN ASSAULT.

  Defines the role of victim during a crime of aggression. Ensures that only properly trained individuals have the means to protect themselves against acts of aggression Individuals who are not properly trained will not be held responsible for any acts committed by the aggressive party involved in an attack on either one's own person or on the person of a family member.
Victims will be relieved to know that there is no legal or moral obligation to defend themselves thus preventing post aggressive crime syndrome and the guilt second guessing themselves with silly 'what if' questions.
In order for there to be a true crime, there must be a a true victim. It is the intent of this bill to ensure that for every crime there is indeed a true victim. This bill will define the role and responsibilities of an individual if they want to enjoy the status and label of 'Crime Victim'.

  SECTION1.A new bill defining the responsibilities of a victim shall be entered as follows:
  3200-00-3006-001  VICTIM RESPONSIBILITIES. NO PERSON WHO HAS NOT BEEN PROPERLY TRAINED MAY TAKE DEFENSIVE ACTION DURING AN ATTEMPTED ROBBERY, RAPE, CAR-JACKING, BURGLARY, MURDER, KIDNAPPING OR ANY OTHER VIOLENT ACTION TO BE NAMED LATER.

  3200-00-3006-002  DEFENSIVE ACTION DEFINED AS DEFENDING ONESELF WITH A FIREARM, KNIFE, HATCHET, CROWBAR, TIRE IRON, METAL PIPE, POT OR PAN, ASHTRAY, SHOT GLASS, LAMP, TREE LIMB LARGER THAN ONE HALF INCH IN DIAMETER, ROCK OR STONE LARGER THAN A PEA.
IN ADDITION IF ONE IS TO BE A TRUE VICTIM, ONE CANNOT RAISE ONE'S HAND TO DEFLECT A POTENTIALLY HARMFUL BLOW FROM AN ATTACKER OR OBJECT EMPLOYED BY AN AGGRESSIVE PARTY DURING AN ASSAULT.

  3200-00-3006-003  PROTECTIVE CLOTHING TO BE CLASSIFIED AS A TRUE VICTIM OF A CRIME OF AGGRESSION ONE MAY NOT WEAR ANY KIND OF BODY ARMOR OR PROTECTION THAT WOULD LESSEN THE POTENTIAL DAMAGE CAUSED BY AN ASSAILANT'S WEAPON.

  3200-00-3006-004  VICTIM AGGREVATION TO BE CLASSIFIED AS A TRUE VICTIM ONE SHALL NOT IN ANY WAY AGGREVATE THE SITUATION BY ANGERYING THE ASSAILANT. RUNNING FROM AN ASSAULT, PUTTING A BARRIER BETWEEN AN ASSAILANT AN VICTIM, SUCH AS CLOSING A DOOR, OR REFUSING TO PRODUCE THE INTENDED PHYSICAL EVIDENCE OF A CRIME SUCH AS A WALLET FULL OF CASH OR A PLEASURABLE BODY PART WILL ONLY AGGREVATE THE SITUATION AND MAY BE A CAUSE FOR LOSS OF VICTIM STATUS.

  SECTION2.Effective date.This act shall take effect at 12:01 a.m. on the day following the expiration of the ninety-day period after final adjournment of the general assembly that is allowed for submitting a referendum petition pursuant to article V, section 1 (3) of the state constitution; except that, if a referendum petition is filed against this act or an item, section, or part of this act within such period, then the act, item, section, or part, if approved by the people, shall take effect on the date of the official declaration of the vote thereon by proclamation of the governor.
